1. Data controller

The controller of your personal data is Natural Systems Agrotech S.L. (owner of the Nano® brand), tax ID B14757017, registered office at C/ Los Tejares 5, 14540 La Rambla, Córdoba (Spain). Below we inform you of the personal data collected and processed through the use of this website.

2. Data processed and how it is obtained

We process the personal data that you provide to us, as well as other data generated in the context of your activity on our website, such as the operations you carry out, provided that such collection is permitted by Law.

(a) Information you provide to us

We may process the following categories of personal data provided by you when completing the form:

• Identifying data: such as name, surname, sex, tax/ID number, telephone, email, postal address.
• Browsing data: such as information collected through cookies.

(b) Other information about you

Finally, we may also collect data from the use you make of the Portal, such as browsing the website as well as when you contact us through the Customer Service.

(c) Data processed by the anti-fraud system of the form

When you submit the contact form, Google reCAPTCHA v3 is executed. It collects and sends to Google data such as your IP address, information about your browser and device and your interaction behaviour with the page, for the sole purpose of computing a score that distinguishes a person from an automated program. We only receive that score, never the raw data. You can review the processing carried out by Google in its Privacy Policy.

3. Purposes and legal basis

Your personal data will be processed for the following purposes and on the following legal bases:

• To handle your contact request and answer the questions, suggestions or requests for information you send us through the form. The legal basis is the application of pre-contractual measures taken at your request (Art. 6.1.b GDPR) and, failing that, our legitimate interest in replying to whoever writes to us (Art. 6.1.f GDPR).
• To send you commercial communications about our products and news, only if you tick the corresponding box on the contact form. The legal basis is your express consent (Art. 6.1.a GDPR), which is independent from submitting the form and which you may withdraw at any time, without affecting the lawfulness of the processing carried out beforehand, by writing to hola@nanofertilizantes.com.
• To protect the contact form against spam and automated submissions by means of Google reCAPTCHA v3, on the basis of our legitimate interest (Art. 6.1.f GDPR) in keeping the contact channel operational and secure.
• To measure the use of the website through analytics tools, only if you accept analytics cookies in the cookie notice. The legal basis is your consent (Art. 6.1.a GDPR).
• To comply with the legal obligations applicable to us and respond to requests from the competent authorities (Art. 6.1.c GDPR).
• To bring or defend against claims, on the basis of our legitimate interest (Art. 6.1.f GDPR).

When you submit the contact form we keep, together with your data, the record that you accepted this privacy policy, the date and time of that acceptance, whether or not you consented to receive commercial communications, and the version of the legal text you accepted. This information is stored in order to be able to demonstrate your consent, as required by Article 7.1 GDPR.

4. Retention

We keep the data you provide in the contact form for 12 months from our last communication with you, unless you request its erasure earlier. After that period it is deleted.

If you consented to receive commercial communications, we will process your data for that purpose until you withdraw your consent, which you may do at any time by writing to hola@nanofertilizantes.com.

In both cases, once the processing has ended the data will be blocked for the limitation period of any liabilities that may arise, available solely to judges, courts and competent authorities, and will be permanently erased at the end of that period.

5. Recipients

We do not disclose your personal data to third parties, except in the cases set out below. The following providers access your data as processors, on behalf of and following the instructions of the controller:

• The hosting provider of the website and the database, and the email provider through which the notice of your request is sent to us.
• Google Ireland Limited, as the provider of the anti-fraud protection of the form (reCAPTCHA v3) and, if you accept analytics cookies, of web analytics (Google Analytics).
• Metricool (Metricool Software S.L.), as the provider of audience measurement services, only if you accept analytics cookies.
• The competent courts, tribunals, law enforcement bodies and public authorities, where there is a legal obligation to disclose them.

6. Rights of the data subject

You have the right to have Nano® confirm whether or not your personal data is being processed and, where applicable, to request access to the personal data and to certain information about the processing (purposes, categories of data processed and recipients, among other aspects) (right of access).

Likewise, you have the right to request the rectification of inaccurate data (right to rectification), as well as their erasure when, among other reasons, they are no longer necessary for the purposes for which they were collected (right to erasure). In certain circumstances (for example, if the data subject contests the accuracy of their data, while the accuracy is being verified), you may request that the processing of your personal data be restricted, with such data only being processed for the exercise or defense of claims (right to restriction of processing).

Lastly, you have the option of exercising your right to data portability, that is, to receive the personal data in a structured, commonly used and machine-readable format, and to transmit it to another controller without the controller to whom it was provided preventing it, in the cases legally provided for these purposes (right to data portability). Likewise, in those cases where the processing of your data is based on your consent, you will have the right to withdraw your consent at any time, without this affecting the lawfulness of the processing prior to withdrawal.

You have the right to object to the processing of your data, at any time, for reasons related to your particular situation, when it is based on the legitimate interest of Nano® or a third party and, in particular, when it is intended for direct marketing. In this case, our company will end such processing, unless legitimate grounds are demonstrated to continue with it.

You should not forget that you have the right to lodge a complaint with the Spanish Data Protection Agency, especially when you have not received satisfaction in the exercise of your rights.

7. Servers and International Data Transfers

Your data is stored on servers located in the European Economic Area. However, some of the providers mentioned — notably Google — may process data on servers located outside the EEA. In that case, such transfers rely on the Standard Contractual Clauses approved by the European Commission and/or on the adequacy decision of the EU-US Data Privacy Framework, adopted by the Commission on 10 July 2023, or on any other appropriate safeguard provided for in Chapter V GDPR.
